1. Acceptance of Terms

By accessing or using Dotfiles Market ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. You must be at least 16 years old to create an account or use the Platform. By registering, you confirm that you meet this age requirement.

2. What Dotfiles Market Is

Dotfiles Market is an online marketplace that allows users to upload, share, discover, and download configuration files ("dotfiles") for operating systems, terminal emulators, editors, window managers, and other software. We act as an intermediary platform — we host content uploaded by users but we are not the author, publisher, or distributor of that content.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at contact@dotfiles.market. We reserve the right to suspend or terminate accounts that violate these Terms.

5. User-Generated Content

When you upload content to Dotfiles Market:

• You retain all intellectual property rights in your original content.
• You grant Dotfiles Market a worldwide, non-exclusive, royalty-free licence to display, distribute, and make available your content to users of the Platform.
• You represent and warrant that you have the right to upload the content, and that it does not infringe the intellectual property rights of any third party.
• You are solely responsible for your content and any harm it may cause. We act as an intermediary only and are not the publisher or author of user-submitted content.
• You agree to indemnify and hold harmless Dotfiles Market and its operator from any claims, damages, or expenses arising from content you upload or from your use of the Platform.

6. Prohibited Content

You may not upload, post, or transmit any content that:

• Contains intentional malware, viruses, ransomware, or other malicious code
• Infringes the intellectual property rights of any third party
• Contains sensitive credentials, API keys, passwords, private keys, or access tokens belonging to you or any other person
• Is illegal under applicable law or promotes illegal activity
• Is fraudulent, deceptive, or misleading about its purpose or effects
• Violates the privacy of any individual

7. Content Moderation and Reporting

We reserve the right to remove or restrict access to any content that violates these Terms, but we have no obligation to pre-screen content before it is published. If you believe any content on the Platform is illegal, infringes your rights, or violates these Terms, please report it by emailing contact@dotfiles.market with a description of the content and the reason for your report. You may also use the in-platform report feature where available.

We will review reports and take appropriate action, which may include content removal, account suspension, or referral to law enforcement where required.

8. Copyright and DMCA / Takedown Requests

If you believe content on Dotfiles Market infringes your copyright, please send a written notice to contact@dotfiles.market including:

• Identification of the copyrighted work you claim has been infringed
• The URL or description of the infringing content on our Platform
• Your contact information (name, email address)
• A statement that you have a good faith belief that the use is not authorised
• A statement that the information in your notice is accurate

We will investigate and, where appropriate, remove infringing content and notify the uploader. Repeat infringers will have their accounts terminated.

9. Seller Terms

If you choose to sell content on Dotfiles Market (when payments are enabled):

• You retain all rights to your original content.
• You grant us a licence to display and distribute your content on the Platform.
• You are responsible for ensuring your content does not infringe third-party rights.
• The platform fee is 20% of each sale; you receive 80% of the sale price, minus applicable payment processing fees.
• Payouts are processed via Stripe according to Stripe's payout schedule.
• You are responsible for any taxes applicable to your earnings. We do not withhold tax on your behalf.

10. Purchases, Refunds, and Consumer Rights

All purchases are for digital content delivered immediately upon payment.

Right of withdrawal: Under EU consumer law, you ordinarily have a 14-day right to withdraw from a contract. However, for digital content not supplied on a physical medium, this right is waived once delivery begins — meaning once you start downloading a file you have purchased, you lose the right to withdraw. By completing a purchase and initiating a download, you expressly consent to immediate delivery and acknowledge that you waive your right of withdrawal.

If you experience a technical issue preventing you from accessing a purchase, contact us at contact@dotfiles.market within 14 days of purchase and we will work to resolve it or issue a refund at our discretion.

11. Use Licence for Downloaded Content

When you download a free showcase or purchase paid content, you receive a non-exclusive, non-transferable, personal-use licence to install and use the configuration on your own devices. Unless the uploader specifies a more permissive licence, you may not:

• Redistribute or resell the content
• Sub-licence the content to others
• Represent the content as your own original work

Many creators publish their dotfiles under open-source licences (MIT, GPL, etc.). If the showcase specifies a licence, that licence governs.

12. Disclaimer of Warranties

The Platform and all content available through it are provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access. We do not warrant that the Platform will be free of errors, that defects will be corrected, or that the Platform or the servers that make it available are free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Dotfiles Market and its operator shall not be liable for:

• Any damage to your hardware, software, operating system, or data arising from content downloaded from the Platform
• Any security breach, unauthorised access, or compromise of your system arising from installed dotfiles
• Loss of data, loss of profits, or business interruption
• Any indirect, incidental, special, or consequential damages, even if we have been advised of the possibility of such damages

Nothing in these Terms limits liability that cannot be excluded under applicable EU consumer law, including liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

14. Modifications to the Service and Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the Platform before changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms. If you do not accept the changes, you may close your account before they take effect.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the European Union and the EU member state in which the operator is resident, without regard to conflict of law principles. EU consumer protection laws that provide stronger protections in your country of residence remain unaffected.
